EASY TO TRAVEL USER AGREEMENT (ETTUA)

We are ETT SOLUTIONS DMCC, doing business as easy to travel (hereinafter as "Company", "we", "us", "our"), a company registered in United Arab Emirates, Office 1701 Prime Tower, Business Bay, Dubai. We are operating the website https://www.easyto.travel/, Web services, including API and the mobile application easy to travel (hereinafter as "App" or "ETT App"), as well as any other related products and online cloud services that refer or link to the easy to travel terms of use (hereinafter as "ETTUA") (collectively as "online cloud service" or "ETT Platform").

Account means the part of ETT Platform available to the authorized User, with individual access to detail and history of orders, to obtain additional information about the Airport Facilities, unique offers, and discounts for which the User has issued/accepted an order, or to change their contact information. Creating an Account is a prerequisite for registering with the ETT Platform and accessing certain Airport Facilities offered on ETT Platform.

Airport Facilities refer to various airport services (e.g., VIP lounge, VIP terminal, business lounge, DelayCare and similar Airport Services) or any other services provided by Service Providers, which you can book using ETT Platform.

Agent means a member of a local service delivery team who is engaged as a Service provider by Company.

Booking means transaction to order and purchase an Airport Facilities on the ETT Platform.

Booking Confirmation means the Booking/Voucher with confirmation number and/or booking form/vouchers/e-vouchers with a barcode or QR Code, which will be provided to User(s)

Content means images and other data provided to the User, which may include text, audio, video, graphics, photographs, illustrations and/or similar materials, including trade names, logos, trademarks, and related copyrights.

Customer or User (You and/or Your) the person(s) (passenger(s)) who purchase Airport Facilities bookable on ETT Platform through b2c online services, ETT App or in physical office.

API is an interface that allows ETT Platform to interact with other software.

ETT Platform is an online b2b/b2c booking system developed for the interaction of market participants in the tourism industry, integrated by a single ecosystem, for consolidation, management and distribution of travel content through API, Web services, ETT App and web site ( https://www.easyto.travel/)

ETT App means the mobile application that provides Users access to online cloud services for searching, Booking, and purchasing Airport Facilities through mobile devices.

Passenger means the traveler, person, or group of people to whom the Airport Facilities are delivered.

Party(s) is the ETT, User(s) (Customer(s) and (or) who is engaged by ETTUA and (or) have authorized access to the ETT Platform.)

Payment card means an identification card that allows the cardholder (cardholder) to make a payment by electronic transfer. It is used to pay for goods and services, including via the Internet, using contactless transfer technology, as well as to withdraw cash.

Payment operator is a payment service of banks and / or financial institutions, intended to simplify settlements between individuals, legal entities and / or individual entrepreneurs on the Internet by using personal computers and / or other mobile devices, through which User(s) pay for Airport Facilities

Price means value of the Airport Facilities shown on ETT Platform interface.

Services means online cloud services on ETT Platform which allows the User to purchase Airport Facilities.

Service Provider(s) – an Airport Facilities provider(s).

Signup or Authorization means voluntary procedure when the visitor of ETT Platform fills the form for User Account generation, uniquely identified by pair login (user ID) and password.

Third-party Software means software and/or services of different vendors/licensors/subcontractors integrated into ETT Platform to support the functionality and improve our Services.

Web service is an interface available to the user through Internet access and used to achieve any results (e.g. order and purchase the Airport Facilities).

The ETTUA is an agreement between User and Company concerning Your use and access to the ETT Platform. You agree that by using accesses, You have read, understood, and agreed to be bound by all ETTUA. IF YOU DO NOT AGREE WITH ALL AND (OR) PART OF THE ETTUA, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING AND ACCESS TO THE ETT PLATFORM AND YOU MUST DISCONTINUE USAGE AND ACCESS IMMEDIATELY.

An extra terms and conditions or documents that may be posted on ETT Platform are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to the ETTUA from time to time. We will mark the updating ETTUA by label the "Last updated". It is Your responsibility to review the ETTUA to stay informed of updates. You will be subject to and will be deemed to have been made aware of and to have accepted, the changes in any revised ETTUA by Your continued use of ETT Platform after the date such revised ETTUA are posted.

Company is intended for Users who are at least 18 years of age. All Users who are minors in the jurisdiction in which they reside (generally under the age of 18) must have the permission of, and be directly supervised by, their parent or guardian to use the ETT Platform. If you are a minor, you must have your parent or guardian read and agree to the ETTUA prior to you using the ETT Platform. YOU ARE SOLELY RESPONSIBLE FOR ALL ACTIONS TAKEN ON ETT PLATFORM, INCLUDING ALL DOCUMENTS AND DATA ARE UPLOADED BY YOU.

1. OUR SERVICES AND AIRPORT FACILITIES

The ETT Platform is an online cloud service where Users can search, Book and purchase the Airport Facilities, view details and history of orders, and access catalogs, unique discounts, promotions, etc. By using ETT Platform and accepting the ETTUA, you acknowledge that we are not providing Airport Facilities to You, but only helping You to choose a suitable Airport Facilities of our Service provider and make its purchase on ETT Platform. We (as provider of software) are not responsible for the quality of the Airport Facilities.

We are providing the software for Users as "SaaS" (Software as a service) through online cloud service ETT Platform where the User can purchase the Airport Facilities. We are not guaranteeing the accuracy of photos related to Airport Facilities and other descriptive information. The Content is provided by Service Providers may occur inaccuracies or typographical errors. The Company is not responsible for any inaccuracies or typographical errors.

By booking the Airport Facilities through the ETT Platform, the User enters direct (legally binding) contractual relations with the Service Provider, whose services he or she has booked. The Company acts solely as an intermediary between the User and the Service Provider, transferring the terms of the user's booking to the appropriate Service Provider, sends the Booking Confirmation to the User in the name and on behalf of the Service Provider, and ensures settlements and payment acceptance (if applicable). You agree and are fully acknowledge that under any circumstances the Company is not a party to any agreement for the provision of Airport Facilities between User and the Service Provider.

Any Information about Airport Facilities provided or published on ETT Platform regarding Airport Facilities is provided or published by the relevant Service Provider. The Service Provider shall be fully and solely responsible for the accuracy and relevance of the Information about the Airport Facilities, including, but not limited to: availability of Airport Facilities, conditions of Booking cancellation, conditions of the Service Provider's denial to provide services and the user's refusal to receive services, chargeback policy and other information about the Airport Facilities available for Booking through ETT Platform. The Company does not and cannot guarantee that the Information about Airport Facilities published by the Service Providers on the ETT Platform is accurate, complete, or correct. The Company is not responsible for the verification of the Information about Airport Facilities published by Service Providers on ETT Platform.

To complete the Booking, you must pay the full cost of the Airport Facilities.

You confirm that you have read and unconditionally agree with the rules for Booking and providing Airport Facilities, the terms of Cancellations and Denials, the chargeback policy of your Service Provider.

The availability of Airport Facilities is determined by us on a sole discretionary basis. The description of the Airport Facilities in ETTUA does not guarantee that it will be available for purchase on ETT Platform. You shall not any claim in case if in formation in ETTUA and ETT Platform does not meet your expectation or requirements.

The information provided when using the ETT Platform is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country. Accordingly, those persons who choose to access ETT Platform from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable.

DelayCare. If flight is delayed, the Customer get free one-time access to the lounges available at ETT Platform. In case of flight delay and if the DelayCare service was opted and paid, the ETT Platform issue the lounge access voucher which confirms Customer’s right to use the lounge. The lounge access voucher will be sent to Customer’s e-mail and (or) accessible to download from ETT Platform.

The DelayCare service is chargeable. The ETT Platform is displayed the Fee at the moment of Booking Confirmation (clause 7 ETTUA).

ETT Platform determines flight tracking through the different third-party applications, services and software products (Third-parties Software, clause 14 ETTUA). The Company does not guarantee the accuracy of the data and is not responsible for any errors and (or) defects in the Third-party Software.

If the DelayCare service issue the lounge access voucher, it is issued and valid only for Customer named in air ticket. The lounge access voucher is limited to the flight departure date (cannot be used on any other day of travel).

The lounge access voucher is non-transferable, non-refundable, non-rebookable and it cannot be exchanged for cash. The Customer must ensure that they have all necessary travel documents to access the lounge. Lounge access is available during the opening hours of the lounges, which may be variable and different.

If ETT Platform fail to meet DelayCare conditions, our liability is limited solely to issuing/exchanging the lounge access voucher.

2. INTELLECTUAL PROPERTY

Our intellectual property. We are the owner and (or) the licensor of all intellectual property rights of ETT Platform, including all source code, databases, functionality, software, website designs (hereinafter as Software), Content, as well as the trademarks, service marks, and logos contained therein (the "Trademarks"). Our Software, Content and Trademarks are protected by copyright and trademark laws (and various other intellectual property rights and unfair competition laws). The Software, Content and Trademarks are provided in or through the ETT Platform "AS IS" for Your personal, non-commercial use or internal business purpose only.

Use of ETT Platform. Subject to Your compliance with the ETTUA, including the prohibitions section below, we grant you a non-exclusive, non-transferable, revocable license to: (1) access the ETT Platform; and (2) download or print a copy of any part of the Content to which you have properly gained access. solely for Your personal, non-commercial use or internal business purpose.

Except as set out in this section or elsewhere in the ETTUA, no part of the ETT Platform, no Software, no Content or Trademarks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.

If You wish to make any use of the ETT Platform, Software, Content, or Trademarks other than as defined in this section or elsewhere in the ETTUA, please address Your request to: support@easyto.travel. If We ever grant you the permission to post, reproduce, or publicly display any part of ETT Platform or Content, You must identify Us as the owners and (or) licensors of the ETT Platform, Software, Content, or Trademarks and ensure that any copyright or proprietary notice appears or is visible on posting, reproducing, or displaying.

We reserve all rights not expressly granted to You in and to the ETT Platform, Software, Content, and Trademarks. Any breach of these Intellectual Property will constitute a material breach of the ETTUA and Your right to use ETT Platform, Content, or Trademarks will terminate immediately.

Submissions. Please review this section and the prohibitions section carefully prior to using ETT Platform to understand the (a) rights You give us and (b) obligations You have when you post or upload any content through the ETT Platform. By directly sending Us any question, comment, suggestion, idea, feedback, or other information about the ETT Platform ("Submissions"), you agree to assign to Us all intellectual property rights in such Submission. You agree that We shall own this Submission and be entitled to its unrestricted use and dissemination for any lawful purpose, commercial or otherwise, without acknowledgment or compensation to You. You warrant and represent that Your Submissions do not constitute confidential information. You are solely responsible for Your Submissions, and You expressly agree to reimburse Us for all losses that We may suffer because of Your breach of (a) this section, (b) any third party's intellectual property rights, or (c) Governing law.

3. USER DECLARATIONS

By using the ETT Platform, you declare and warrant that:

(1) all registration information You submit will be true, accurate, current, and complete;

(2) You will maintain the accuracy of such information and promptly update such sign-up information as necessary;

(3) You have the legal capacity and You agree to comply with the ETTUA;

(4) You are not under the age of 18;

(5) You are not a minor in the jurisdiction in which you reside, or if a minor, You have received parental permission to use the ETT Platform;

(6) You will not access the ETT Platform through automated or non-human means, whether through a bot, script or otherwise;

(7) You will not use the ETT Platform for any illegal or unauthorized purpose; and

(8) Your use of the ETT Platform will not violate any applicable law or regulation.

If You provide any information that is untrue, fake, inaccurate, not current (actual), or incomplete, We have the right to suspend usage and (or) terminate Your Account and (or) access and refuse all current or future use of the ETT Platform (or any part thereof).

4. USER SIGN-UP

You may be required to register to use ETT Platform. You agree to keep Your password confidential and will be responsible for all use of Your account and password. We reserve the right to remove, reclaim, or change a username You select if we determine, in Our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.

The ETT Platform can be used by individuals over the age of 18. Signing up for ETT Platform by an underage person is strictly prohibited. By accessing to ETT Platform, and signing up for an Account, You represent and warrant that You are 18 years of age or older, and that You have all the rights and authority necessary to transact and comply with the ETTUA, including that You are of legal age, have full legal capacity, and have legal capacity. We may at any time require you to provide information and documents evidencing Your rights and authority as set forth above.

To use ETT Platform you shall create an Account and become a User.

To create an Account, you can:

(1) fill out all mandatory fields of the sign-up (authorization) application.

(2) or log into ETT Platform through "Microsoft", "Apple", "Google", "Meta" and other methods available on ETT Platform (hereinafter referred to as "Social Media Account"). By using this functionality, You agree that ETT Platform accesses, publishes, and stores certain information from Your Social Network Account on ETT Platform. You have the right to disconnect Your Account at any time. Please see "SOCIAL MEDIA" section of the ETTUA and Our Privacy Policy https://easyto.travel/en/docs/privacy-policy for more information about data usage and the privacy policy of the relevant social media.

To register the User in the ETT App, the User independently makes a download of the ETT App to device using the AppStore (https://www.apple.com/app-store/) and (or) Google Play (https://play.google.com).

To register, You shall read and accept the ETTUA and the Privacy Policy. By creating an Account, regardless of the chosen registration method, you agree to provide accurate and truthful information and to update it in Your Account in a timely and reasonable manner, to ensure its relevance and accuracy throughout the duration of the Terms.

In case of signing up via e-mail and (or) via mobile phone number You undertake to ensure the confidentiality (passwords, logins, codes, etc.) when creating Your Account and not to share it with anyone else. You are solely responsible for the use of Your Account by third parties.

To ensure transparency, increase trust, or prevent or detect fraud, the Company may (but is not obliged to) verify some of the information you provide in your Account. This includes the phone number, mail and payment details You provide. You can also voluntarily verify passport information. The Company cannot guarantee the validity, reliability and accuracy of any information that has been verified.

It is forbidden to create multiple Accounts for one User (Prohibition of Multiple Accounts). If you sign up for on ETT Platform, You give us Your consent to use Your personal information in accordance with the privacy policy https://easyto.travel/en/docs/privacy-policy

5. USER DATA

We will maintain certain data that You transmit to the Company for the purpose of managing the performance of the ETT Platform, as well as data relating to Your use of the ETT Platform. Although We perform regular routine backups of data, You are solely responsible for all data that You transmit or that relates to any activity You have undertaken using the ETT Platform. You agree that We shall have no liability to You for any loss or corruption of any such data, and You hereby waive any right of action against Us arising from any such loss or corruption of such data.

6. PURCHASES AND PAYMENTS

Prices are based on the currency of Your choice at the time of booking. Price quotations and price tables may change without notice however it will not affect any confirmed bookings. If a material amendment to an order or Booked Airport Facilities is requested by the traveler or booker and is accepted by ETT Platform then the amended Price will use the exchange rates and tariffs subsisting at the time of change and extra charges may be payable. The base Price quoted at the time of ordering will include all knowable charges for the Airport Facilities that has been ordered. Prices do not include foreign departure tax, security, port charges, customs, immigration, agricultural, passenger-facility charges or international transportation tax or any local airport taxes either imposed by airport, airline, or any airport contractor. Prices do not include discretionary tips/gratuities to representatives; or passport and visa fees; or baggage and personal insurance. Prices do not include provision for a porter, lounge access or in terminal buggy unless booked at additional costs and confirmed in the booking confirmation.

If the Customer makes a purchase on ETT Platform using the promotion code, or if the Customer accepts a discount or special-offer price during the ETT Platform checkout or ordering process, the Customer may invalidate that discount or special-offer price by making any changes or amendments to the original itinerary once the purchase is complete. The Company may decide, at its sole discretion, to honor the awarded discount or special-offer pricing if the Customer makes a post-purchase change or amendment. The Company reserves the right to invalidate the Customer discount or special-offer pricing in case of the Customer making any change to the service originally ordered.

Access to ETT Platform is free of charge. The ETT Platform automatically calculates the Price of the Airport Facilities, which includes the cost of the selected Airport Facilities and the Airport Facilities Fee. The intelligent algorithms of the ETT Platform operate in dynamic pricing mode, where the cost of the Airport Facilities and ETT Platform Fee are determined based on constantly changing factors, such as estimated time and distance, time of arrival/departure, number of Passengers, size, and number of pieces of luggage, projected route, estimated traffic, quantity, etc.

The ETT Platform stores the history of all orders of the User. The registered User may at any time obtain details and a history of all orders for any period starting from the date of his or her registration on ETT Platform.

To pay for the Airport Facilities, the User ties (enters data) to ETT Platform his Payment cards which are automatically integrated with ETT Platform, from which the funds will be deducted to pay for the Airport Facilities under the ETTUA. It is allowed to use payment cards only of those payment systems which are specified in ETT Platform and can make Internet payments. Usually these payment systems are VISA/MasterCard. The possibility of Internet payments is provided by the User independently through the issuing bank of the Payment card (Visa, Mastercard, American Express, Discover, PayPal, Adyen, etc. systems available on ETT Platform).

When you are choosing the method of payment "by Payment card" after the Booking of the Airport Facilities, the User will be redirected to the secure payment page of the relevant payment system or the system of the relevant bank, where he or she must enter the data of his or her Payment card. For additional authentication of the holder the 3D Secure protocol is used. If the User's bank supports this technology, the User will be redirected to its server for additional identification. Information about the rules and methods of additional identification the User can specify in the bank, which issued his Payment card.

The User has an opportunity to link the Payment Card to his Account. Afterwards, the amount of any subsequent order of the User will be automatically debited from the Payment Card attached to the Account without specifying any details, provided that the User confirms the payment by pressing the "Pay" button in the Account and entering a one-time password, provided that the issuing bank of the User's Payment Card provides for the use of such protection. The debited amount from the User's Payment Card is held until the moment of successful rendering of the Airport Facilities.

The funds are refunded only to the Payment card from which the payment was made, in accordance with the rules of international payment systems and Governing law. The use of Payment card may be chargeable. No refunds will be made for Payment card charge or service fee.

When you make online payments, your data is protected and processed according to the PCI DSS security standard. Transmission of information to the payment gateway is performed using SSL encryption technology. Further transmission of information occurs through closed banking networks, which have the highest level of security. All payment operations are performed in accordance with the requirements of international payment systems. When transmitting information, special security technologies of online card payments are used, data processing is carried out on a secure high-tech server of the processing company.

We are not responsible for operations related to online payments. The authorization of the online operations is carried out by the bank. If the bank has reasons to believe that the operation is fraudulent in nature, the bank has the right to refuse to carry out this operation. Fraudulent transactions with the Payment cards are a criminal offense.

You agree to provide current, complete, and accurate purchase and account information for all purchases made via the ETT Platform. You further agree to promptly update account and payment information, including email address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as needed. Sales tax will be added to the price of purchases as deemed required by us. We may change prices at any time.

You agree to pay all charges at the prices then in effect for your purchases and you authorize us to charge your chosen payment provider for any such amounts upon placing your order. We reserve the right to correct any errors or mistakes in pricing, even if we have already requested or received payment.

We reserve the right to refuse any order placed through the ETT Platform. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same Customer Account, the same payment method, etc. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.

7. BOOKING CONFIRMATION

To complete the Booking, you shall pay the full cost of the Airport Facilities indicated in your request on ETT Platform. Booking has been confirmed by the Service Provider and you will get the Booking Confirmation in final. Booking Confirmation confirms your right to use the Airport Facilities.

8. CANCELATION, DENIAL AND CHARGEBACK POLICY

You acknowledge and agree that even after confirming the Booking of the Airport Facilities, the Service Providers reserve the right to cancel the Booking or deny the provision of the Booked Airport Facilities (hereinafter referred to as "Cancellations and Denials"). Each Airport Facilities Service Provider establishes Cancellations and Denials rules and chargeback policy independently and you shall follow it. You have the right to be subject to the Cancellations and Denials rules, as well as the chargeback policy in effect at the time of your Booking of the Airport Facilities. The Service Provider may charge cancelation fee or provide non-refundable fares. The information about Cancelation and Denials rules is available for you upon Booking. You shall read the terms of the fare and cancellation/chargeback policy before Booking. If you purchase the Airport Facilities on ETT Platform you considered agree with cancellation/chargeback policy of the Service Provider. A request to cancel a Booking at the initiative of the User must be sent by the User(s) via ETT Platform. 9. PROVISION OF AIRPORT FACILITIES

The Airport Facilities are subject to availability. Company or any authorized personnel of the Airport Facilities shall reserve the right to refuse admission or to remove any User(s), at its full and absolute discretion, if: (a) the User(s) appear to be under the influence of alcohol or prohibited drugs and are likely to disturb the peace and comfortable usage of the Airport Facilities; (b) the User(s) have created and continued to create scandalous scenes or have exhibited and continued to exhibit unruly behavior that disturbs another person(s) in the Airport Facilities; (c) the User(s) have been causing nuisances or disruptions which are dangerous to the User(s) himself / herself / themselves and/or to any other persons and/or with the likelihood of causing damage to any property both within and outside the Airport Facilities; (d) for health and safety reasons; (e) for environmental and security reasons; or (f) for any other reasons of which the circumstances justify such refusal or removal.

10. PROHIBITIONS

You may not access or use the ETT Platform for any purpose other than that for which we make the ETT Platform available. The ETT Platform may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us.

As a User of the ETT Platform, you agree not to:

(1) Systematically retrieve data or other content from the ETT Platform to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.

(2) Trick, defraud, or mislead us and other Users, especially in any attempt to learn sensitive Account information such as User passwords.

(3) Circumvent, disable, or otherwise interfere with security-related features of the ETT Platform, including features that prevent or restrict the use or copying of any Content or enforce limitations on the use of the ETT Platform and/or the Content contained therein.

(4) Disparage, tarnish, or otherwise harm, in our opinion, us and/or the ETT Platform.

(5) Use any information obtained from the ETT Platform to harass, abuse, or harm another person.

(6) Make improper use of our support or submit false reports of abuse or misconduct.

(7) Use the ETT Platform in a manner inconsistent with any applicable laws or regulations.

(8) Engage in unauthorized framing of or linking to the ETT Platform.

(9) Upload or transmit (or attempt to upload or to transmit) viruses, trojans, or other material, including excessive use of capital letters and spamming (continuous posting of repetitive text), that interferes with any party's uninterrupted use and enjoyment of the ETT Platform or modifies, impairs, disrupts, alters, or interferes with the use, features, functions, operation, or maintenance of the ETT Platform.

(10) Engage in any automated use of the system, such as using scripts to send comments or messages, or using any data mining, robots, or similar data gathering and extraction tools.

(11) Delete the copyright or other proprietary rights notice from any Content.

(12) Attempt to impersonate another User or person or use the username of another User.

(13) Upload or transmit (or attempt to upload or to transmit) any material that acts as a passive or active information collection or transmission methods, including without limitation, clear graphics interchange formats ("gifs"), 1×1 pixels, web bugs, cookies, or other similar devices (sometimes referred to as "spyware" or "passive collection mechanisms" or "pcms").

(14) Interfere with, disrupt, or create an undue burden on the ETT Platform or the networks or services connected to the ETT Platform.

(15) Harass, annoy, intimidate, or threaten any of our employees or agents engaged in providing any portion of the ETT Platform to you.

(16) Attempt to bypass any measures of the ETT Platform designed to prevent or restrict access to the ETT Platform, or any part of the ETT Platform.

(17) Copy or adapt the ETT Platform software, including but not limited to Flash, PHP, HTML, JavaScript, or other code.

(18) Except as permitted by Governing law, decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the ETT Platform.

(19) Except as may be the result of standard search engine or Internet browser usage, use, launch, develop, or distribute any automated system, including without limitation, any spider, robot, cheat utility, scraper, or offline reader that accesses the ETT Platform, or use or launch any unauthorized script or other software.

(20) Use a buying agent or purchasing agent to make purchases on the ETT Platform.

(21) Make any unauthorized use of the ETT Platform, including collecting usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email, or creating user accounts by automated means or under false pretenses.

(22) Use the ETT Platform as part of any effort to compete with us or otherwise use the ETT Platform and/or the Content for any revenue-generating endeavor or commercial enterprise.

(23) Use the ETT Platform to advertise or offer to sell services.

(24) Sell or otherwise transfer your Account.

11. USER CONTRIBUTION LICENSE

You agree that we may access, store, process, and use any information and personal data that you provide following the terms of the Privacy Policy and your choices (including settings).

By submitting suggestions or other feedback regarding the ETT Platform, you agree that we can use and share such feedback for any purpose without compensation to you.

12. REVIEWS AND FEEDBACK

We may provide you areas on the ETT Platform to leave reviews or ratings. When posting a review, you must comply with the following criteria: (1) you should have firsthand experience with the person/entity being reviewed; (2) your reviews should not contain offensive profanity, or abusive, racist, offensive, or hateful language; (3) your reviews should not contain discriminatory references based on religion, race, gender, national origin, age, marital status, sexual orientation, or disability; (4) your reviews should not contain references to illegal activity; (5) you should not be affiliated with competitors if posting negative reviews; (6) you should not make any conclusions as to the legality of conduct; (7) you may not post any false or misleading statements; and (8) you may not organize a campaign encouraging others to post reviews, whether positive or negative.

We may accept, reject, or remove reviews in our sole discretion. We have absolutely no obligation to screen reviews or to delete reviews, even if anyone considers reviews objectionable or inaccurate. Reviews are not endorsed by us, and do not necessarily represent our opinions or the views of any of our affiliates or Service Provider. We do not assume liability for any review or for any claims, liabilities, or losses resulting from any review. By posting a review, you hereby grant to us a perpetual, non-exclusive, worldwide, royalty-free, fully paid, assignable, and sublicensable right and license to reproduce, modify, translate, transmit by any means, display, perform, and/or distribute all content relating to review.

13. MOBILE APP LICENSE

User License If you access the Airport Facilities via the ETT App, then we grant you a revocable, nonexclusive, non-transferable, limited right to install and use the ETT App on wireless electronic devices owned or controlled by you, and to access and use the ETT App on such devices strictly in accordance with ETTUA. You shall not: (1) except as permitted by Governing law, decompile, reverse engineer, disassemble, attempt to derive the source code of, or decrypt the ETT App; (2) make any modification, adaptation, improvement, enhancement, translation, or derivative work from the ETT App; (3) violate any applicable laws, rules, or regulations in connection with your access or use of the ETT App; (4) remove, alter, or obscure any proprietary notice (including any notice of copyright or trademark) posted by us or the licensors of the ETT App; (5) use the ETT App for any revenue-generating endeavor, commercial enterprise, or other purpose for which it is not designed or intended; (6) make the ETT App available over a network or other environment permitting access or use by multiple devices or users at the same time; (7) use the ETT App for creating a product, service, or software that is, directly or indirectly, competitive with or in any way a substitute for the ETT App; (8) use the ETT App to send automated queries to any website or to send any unsolicited commercial email; or (9) use any proprietary information or any of our interfaces or our other intellectual property in the design, development, manufacture, licensing, or distribution of any applications, accessories, or devices for use with the ETT App.

App stores (Apple and Android devices) The following terms apply when you use the ETT App obtained from either the Apple Store or Google Play (each an "App Distributor"). The license granted to you for our ETT App is limited to a non-transferable license to use the application on a device that utilizes the Apple iOS or Android operating systems, as applicable, and in accordance with the usage rules set forth in the applicable App Distributor's terms of service. Apple Store. By downloading the ETT App from an Apple Inc. ("Apple") device or from the Apple AppStore, you acknowledge and agree that: (i) The ETTUA is between the ETT and you; Apple is not a party to the ETTUA. (ii) the rights granted to you under the ETTUA are limited to your personal, limited, nontransferable right to install the ETT App on Apple devices that you own or operate for personal, non-commercial use, subject to the usage rules set forth in the Apple AppStore services. (iii) Apple is not responsible for the ETT Platform or its Content and has no obligation to provide any service or support for the ETT App. (iv) if the ETT App fails to comply with the applicable warranty, you may notify Apple, and Apple will refund your purchase price of the ETT App, if any. To the maximum extent permitted by Governing Law, Apple will have no other warranty obligations with respect to the ETT App. (iii) Apple is not responsible for any claims from you or any third party relating to ETT App, your possession or use of ETT App, including without limitation (a) product quality claims; (b) any claims that ETT App does not comply with all applicable laws and regulations; and (c) claims arising under consumer protection or similar laws. (iv) If any third party claims that ETT App or your use of ETT App infringes such third partys intellectual property rights, Apple will not be responsible for investigating, defending, resolving or dismissing such intellectual property infringement claims. (iii) You represent and warrant that (a) You are not located in a country that is subject to a U.S. Government embargo or has been designated by the U.S. Government as a "terrorist supporting" country; and (b) You are subject to any restrictions by the U.S. Government. (iv) Apple and its subsidiaries are third party beneficiaries of the ETTUA, and upon your acceptance of the ETTUA, Apple will have the right (and will be deemed to have accepted the right) to enforce these terms against you as a third-party beneficiary of the ETTUA. Google Play. By downloading the ETT App from the Google Play app store (or its successors) operated by Google, Inc. or one of its affiliates ("Google"), you acknowledge and agree that: (i) in the event of a conflict between (a) the Google Play User Agreement, the Google Play Business and Program Policy, or other agreements that Google defines by default as the Google Play app store end user license (which are collectively referred to as "Google Play Agreements"), and (b) other terms and conditions in the agreement, the Google Play Agreements will apply to your use of the ETT App that you downloaded from Google Play, and (ii) Google shall not be responsible or liable in any way for the compliance or noncompliance of the ETT App or you (or any other User) with the Google Play Agreement or the Google Play Agreement.

14. THIRD-PARTY SOFTWARE

We may use third-party applications, services, software products or APIs. For example, we use Google Maps service (https://www.google.ru/maps) to determine geolocation; Flightradar and Variflight to track real-time information about aircraft and flight status data (https://www.flightradar24.com/,https://www.variflight.com/), etc.

By using ETT Platform you agree to accept the terms of use of those third-party applications, services, products, or APIs. Some of these apps, services, software products or APIs have their own licenses and terms of use.

The ETT Platform provides any Third-Party Software to you in accordance with the standard license terms provided by the applicable third party. Your use of any Third-Party Software as part of the Services or that integrates with our software is subject to the terms of the agreement with the provider of that Third-Party Software and its warranties. We are not responsible for the performance, features or failures of the Third-Party Software and make no warranty as to the suitability of the Third-Party Software for your purposes.

15. SOCIAL MEDIA

As part of the functionality of the ETT Platform, you may link your account (each such account, a "Social Media Account") with online accounts you have with third-party service providers (hereinafter as "Social Media Provider") by either: (1) providing your Social Media Account login information through the ETT Platform; or (2) allowing us to access your Social Media Account, as is permitted under the applicable terms and conditions that govern your use of each Social Media Account.

You represent and warrant that you are entitled to disclose your Social Media Account login information to us and/or grant us access to your Social Media Account, without breach by you of any of the terms and conditions that govern your use of the applicable Social Media Account, and without obligating us to pay any fees or making us subject to any usage limitations imposed by the third-party service provider of the Social Media Account. By granting us access to any Social Media Accounts, you understand that (1) we may access, make available, and store (if applicable) any content that you have provided to and stored in your Social Media Account (the "Social Media Content") so that it is available on and through the ETT Platform via your Account, including without limitation any friend lists and (2) we may submit to and receive from your Social Media Account additional information to the extent you are notified when you link your Account with the Social Media Account. Depending on the Social Media Accounts you choose and subject to the privacy settings that you have set in such Social Media Accounts, personally identifiable information that you post to your Social Media Accounts may be available on and through your Account on the ETT Platform. Please note that if a Social Media Account or associated service becomes unavailable or our access to such Social Media Account is terminated by the Social Media Provider, then Social Media Content may no longer be available on and through the ETT Platform.

You will have the ability to disable the connection between your Account on the ETT Platform and your Social Media Accounts at any time. PLEASE NOTE THAT YOUR RELATIONSHIP WITH THE THIRD-PARTY SERVICE PROVIDERS ASSOCIATED WITH YOUR SOCIAL MEDIA ACCOUNTS IS GOVERNED SOLELY BY YOUR AGREEMENT(S) WITH SUCH SOCIAL MEDIA PROVIDERS. We make no effort to review any Social Media Content for any purpose, including but not limited to, for accuracy, legality, or non-infringement, and we are not responsible for any Social Media Content. You acknowledge and agree that we may access your email address book associated with a Social Media Account and your contacts list stored on your mobile device or tablet computer solely for purposes of identifying and informing you of those contacts who have also registered to use the ETT Platform. You can deactivate the connection between the ETT Platform and your Social Media Account by contacting us using the contact information below or through your Account settings (if applicable). We will attempt to delete any information stored on our servers that was obtained through such Social Media Account, except the username and profile picture that become associated with your Account.

16. ADVERTISERS

We allow advertisers to display their advertisements and other information in certain areas of the ETT Platform, such as sidebar advertisements or banner advertisements. We simply provide the space to place such advertisements, and we have no other relationship with advertisers.

17. MANAGEMENT

We reserve the right, but not the obligation, to:

(1) monitor for violations of these ETTUA;
(2) take appropriate legal action against anyone who, in our sole discretion, violates the law or these Terms, including without limitation, reporting such user to law enforcement authorities;
(3) in our sole discretion and without limitation, refuse, restrict access to, limit the availability of, or disable (to the extent technologically feasible) any of your Declarations or any part thereof;
(4) in our sole discretion and without limitation, notice, or liability, to remove from the ETT Platform or otherwise disable all files and content that are excessive in size or are in any way burdensome to our systems; and
(5) otherwise manage the ETT Platform in a manner designed to protect our rights and property and to facilitate the proper functioning of the ETT Platform.

18. PRIVACY POLICY

By using the ETT Platform, you agree to be bound by our Privacy Policy, which is incorporated into ETTUA. Please be advised the ETT Platform are hosted in UAE. If you access the ETT Platform from any other region of the world with laws or other requirements governing personal data collection, use, or disclosure that differ from Governing laws in UAE, then through your continued use of the ETT Platform, you are transferring your data to UAE, and you expressly consent to have your data transferred to and processed in UAE.

The contact information and other information about the User when signing up with ETT Platform (creating an Account) and when the User changes the Account is automatically transmitted to the ETT Platform servers when the User uses ETT Platform through the software installed on the User's device, including the IP address, cookie information, information about the User's browser (or other program with which access to ETT Platform is made), access time, the address of the requested page.

The ETT Platform does not verify the accuracy of the data provided by Users and does not monitor their competence. The ETT Platform assumes that the User provides accurate and sufficient information to communicate with the User on the issues proposed in the registration form and keeps this information up to date.

The User can at any time change (update, supplement) the information or part of it by using the function of editing the registration information in the Account. The User has the right to delete his Account in ETT Platform on his own or by contacting support@easyto.travel.

The ETT Platform has no control over, and assumes no responsibility for, Third Party websites that Users may access through links available from ETT Platform. Such websites may collect or solicit other information from the User and may engage in other activities.

19. TERM AND TERMINATION

These Terms shall remain in legal force and effect while you use the ETT Platform. WITHOUT LIMITING ANY OTHER PROVISION OF ETTUA, WE RESERVE THE RIGHT TO, IN OUR SOLE DISCRETION AND WITHOUT NOTICE OR LIABILITY, DENY ACCESS TO AND USE OF THE ETT PLATFORM (INCLUDING BLOCKING CERTAIN IP ADDRESSES), TO ANY PERSON FOR ANY REASON OR FOR NO REASON, INCLUDING WITHOUT LIMITATION FOR BREACH OF ANY DECLARATION, WARRANTY, OR COVENANT CONTAINED IN ETTUA OR OF ANY APPLICABLE LAW OR REGULATION. WE MAY TERMINATE YOUR USE OR PARTICIPATION IN THE ETT PLATFORM OR DELETE YOUR ACCOUNT AND ANY CONTENT OR INFORMATION THAT YOU POSTED AT ANY TIME, WITHOUT WARNING, IN OUR SOLE DISCRETION.

If we terminate or suspend your Account for any reason, you are prohibited from registering and creating a new account under your name, a fake or borrowed name, or the name of any third party, even if you may be acting on behalf of the third party. In addition to terminating or suspending your Account, we reserve the right to take appropriate legal action, including without limitation pursuing civil, criminal, and injunctive redress.

Termination of the Terms for any reason shall not relieve the Users from liability for breach of the Terms arising during the term of its validity.

20. AMENDMENTS, MODIFICATIONS AND DOWN TIME

We reserve the right to change, modify, or remove the contents of the ETT Platform at any time or for any reason at our sole discretion without notice. However, we have no obligation to update any information on ETT Platform. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the ETT Platform.

We cannot guarantee the ETT Platform will be always available. We may experience hardware, software, or other problems or need to perform maintenance related to the ETT Platform, resulting in interruptions, delays, or errors. We reserve the right to change, revise, update, suspend, discontinue, or otherwise modify the ETT Platform at any time or for any reason without notice to you. You agree that we have no liability whatsoever for any loss, damage, or inconvenience caused by your inability to access or use the ETT Platform during any downtime or discontinuance of the ETT Platform. Nothing in these Terms will be construed to obligate us to maintain and support the ETT Platform or to supply any corrections, updates, or releases in connection therewith.

21. GOVERNING LAW

The ETTUA are governed by and interpreted following the laws of UAE and international law. If your habitual residence is in the EU, and you are a consumer, you additionally possess the protection provided to you by obligatory provisions of the law in your country to residence. The Company and you both agree to submit to the non-exclusive jurisdiction of the courts of UAE, which means that you may make a claim to defend your consumer protection rights regarding ETTUA in UAE, or in the country in which you reside.

22. DISCLAIMER

THE ETT PLATFORM IS PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE ETT PLATFORM WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE ETT PLATFORM AND YOUR USE THEREOF, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THE ETT PLATFORM CONTENT OR THE CONTENT OF ANY WEBSITES OR MOBILE APPLICATIONS LINKED TO THE ETT PLATFORM AND WE WILL ASSUME NO LIABILITY OR RESPONSIBILITY FOR ANY (1) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT AND MATERIALS, (2) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF THE ETT PLATFORM SERVICES, (3) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (4) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE ETT PLATFORM, (5) ANY BUGS, VIRUSES, TROJANS, OR THE LIKE WHICH MAY BE TRANSMITTED TO OR THROUGH THE ETT PLATFORM BY ANY THIRD PARTY, AND/OR (6) ANY ERRORS OR OMISSIONS IN ANY CONTENT AND MATERIALS OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE ETT PLATFORM. WE DO NOT WARRANT, ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY PRODUCT OR SERVICE ADVERTISED OR OFFERED BY A THIRD PARTY THROUGH THE ETT PLATFORM, ANY HYPERLINKED WEBSITE, OR ANY WEBSITE OR MOBILE APPLICATION FEATURED IN ANY BANNER OR OTHER ADVERTISING, AND WE WILL NOT BE A PARTY TO OR IN ANY WAY BE RESPONSIBLE FOR MONITORING ANY TRANSACTION BETWEEN YOU AND ANY THIRD-PARTY PROVIDERS OF PRODUCTS OR SERVICES. AS WITH THE PURCHASE OF A PRODUCT OR SERVICE THROUGH ANY MEDIUM OR IN ANY ENVIRONMENT, YOU SHOULD USE YOUR BEST JUDGMENT AND EXERCISE CAUTION WHERE APPROPRIATE.

23. LIMITATIONS OF LIABILITY

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE ETT PLATFORM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

24. INDEMNIFICATION

You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys fees and expenses, made by any third party due to or arising out of:

(1) use of the ETT Platform;
(2) breach of the ETTUA;
(3) any breach of your Declarations and warranties set forth in the ETTUA;
(4) your violation of the rights of a third party, including but not limited to intellectual property rights; or
(5) any overt harmful act toward any other User of the ETT Platform whom you connected via the ETT Platform.

Notwithstanding the foregoing, we reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate, at your expense, with our defense of such claims. We will use reasonable efforts to notify you of any such claim, action, or proceeding which is subject to this indemnification upon becoming aware of it.

25. E-COMMUNICATIONS, SIGNATURES AND TRANSACTIONS

Visiting the ETT Platform, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications, and you agree that all agreements, notices, disclosures, and other communications we provide to you electronically, via email and on the ETT Platform, satisfy any legal requirement that such communication be in writing. YOU HEREBY AGREE TO THE USE OF ELECTRONIC SIGNATURES, CONTRACTS, ORDERS, AND OTHER RECORDS, AND TO ELECTRONIC DELIVERY OF NOTICES, POLICIES, AND RECORDS OF TRANSACTIONS INITIATED OR COMPLETED BY US OR VIA THE ETT PLATFORM. You hereby waive any rights or requirements under any statutes, regulations, rules, ordinances, or other laws in any jurisdiction which require an original signature or delivery or retention of non-electronic records, or to payments or the granting of credits by any means other than electronic means.

26. MISCELLANEOUS

The ETTUA and any policies or operating rules posted by us on the ETT Platform or in respect to the ETT Platform constitute the entire agreement and understanding between you and us. Our failure to exercise or enforce any right or provision of the ETTUA shall not operate as a waiver of such right or provision. The ETTUA fully operate permissible by law. We may assign any or all our rights and obligations to others at any time. We shall not be responsible or liable for any loss, damage, delay, or failure to act caused by any cause beyond our reasonable control. If any provision or part of a provision of the ETTUA is determined to be unlawful, void, or unenforceable, that provision or part of the provision is deemed severable from these Terms and does not affect the validity and enforceability of any remaining provisions. There is no joint venture, partnership, employment, or agency relationship created between you and us because of the ETTUA or use of the ETT Platform. You agree that the ETTUA will not be construed against us by virtue of having drafted them. You hereby waive all defenses you may have based on the electronic form of the ETTUA and the lack of signing by the parties hereto to execute the ETTUA.
