We are ETT Solutions DMCC, doing business as EasyToTravel(hereinafter as"Company","we,""us,""our"), a company registered in United Arab Emirates DMCC Business Centre Level No 1 Jewellery & Gemplex 3 Dubai, Unit No: 1103. We operate the website http://easyto.travel, the mobile application EasyToTravel (hereinafter as "App" or “EasyToTravel App”), as well as any other related products and online cloud services that refer or link to these legal terms (hereinafter as "Terms") (collectively as "online cloud service" or “EasyToTravel”).

Account means the part of EasyToTravel available to the authorized User, with individual access to detail and history of orders, to obtain additional information about the Travel services, unique offers, and discounts for which the User has issued/accepted an order, or to change their contact information. Creating an Account is a prerequisite for registering with the EasyToTravel and accessing certain Travel services offered through EasyToTravel.
Agent means a member of a local service delivery team who is engaged as a Service partner by EasyToTravel.
Bookingmeans transaction to order and purchase Travel services on the EasyToTravel.
Contentmeans images and other data provided to the User, which may include text, audio, video, graphics, photographs, illustrations and/or similar materials, including trade names, logos, trademarks, and related copyrights.
Customer or User (You and/or Your)means the person or entity who has booked and paid for the Travel services on EasyToTravel.
EasyToTravel means online cloud service for searching, Booking, and purchasing Travel services for Passengers at Airports.
EasyToTravel App is a mobile application that provides device of Users with access to use online cloud services for searching, Booking, and purchasing Travel services or for other activities available in the public part of the EasyToTravel and in the Account.
Meating point means the place at which you are greeted, met, or collected by the Agent or its affiliate.
Passangeer means the traveler, person, or group of people to whom the Travel service is delivered.
Payment card means an identification card that allows the cardholder (cardholder) to make a payment by electronic funds transfer. It is used to pay for goods and services, including via the Internet, using contactless transfer technology, as well as to withdraw cash.
Price means value of the Travel services shown on EasyToTravel interface.
Services means online cloud services on EasyToTravel which allows the User Book and purchase Travel services.
Services partner means a third-party provider of Travel services who contracting with EasyToTravel.
Signup or Authorization means voluntary procedure during which the visitor fills in the form placed on EasyToTravel, based on which a User Account is created in the database, uniquely identified by a unique pair of access details login (user ID) and password.
Third-party Software means software and/or services of different vendors/licensors/subcontractors integrated into EasyToTravel to support the functionality and improve our Services. Travel services
Travel services means services for Passengers to make travel more comfortable and easy e.g. lounge, fast track, meet, assist, and other related services provided by the Service partners (lounge, transfer, dinner, spa, retail etc.)

These Terms constitute a legally binding agreement made between Customer or User, whether personally or on behalf of an entity (hereinafter as"you"), and EasyToTravel, concerning your use and access to the Services. You agree that by using accessing the Services, you have read, understood, and agreed to be bound by all these Terms. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING AND ACCESS TO THE SERVICES AND YOU MUST DISCONTINUE USE AND ACCESS IMMEDIATELY.
An extra terms and conditions or documents that may be posted on EasyToTravel from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Terms from time to time. We will mark the updating Terms by label the "Last updated". It is your responsibility to periodically review these Terms to stay informed of updates. You will be subject to and will be deemed to have been made aware of and to have accepted, the changes in any revised Terms by your continued use of EasyToTravel after the date such revised Terms are posted.
EasyToTravel is intended for Users who are at least 18 years of age. All Users who are minors in the jurisdiction in which they reside (generally under the age of 18) must have the permission of, and be directly supervised by, their parent or guardian to use the EasyToTravel. If you are a minor, you must have your parent or guardian read and agree to these Terms prior to you using the EasyToTravel. YOU ARE SOLELY RESPONSIBLE FOR ALL ACTIONS TAKEN ON EASYTOTRAVEL, INCLUDING ALL DOCUMENTS YOU UPLOAD.

1. OUR SERVICES AND TRAVEL SERVICES

The EasyToTravel is an online cloud service where Users can search, Book and purchase Travel services, view details and history of orders, and access catalogs, unique discounts, promotions, etc. By using EasyToTravel and accepting the Terms, you acknowledge that we are not providing Travel services to you, but only helping you choose a suitable Travel service of our Service Partner and make its purchase on EasyToTravel. We (as provider of software) are not responsible for the quality of Travel service.
We are providing of software for Users as “SAAS” (Software as a service) through online cloud service EasyToTravel where the User can Book and purchase Travel services Inaccuracies or typographical errors may occur in the Content provided by Service Partners. We are not guaranteeing the accuracy of photos related to services and other descriptive information. The EasyToTravel is not responsible for any inaccuracies.

TRAVEL SERVICES DESCRIPTION

FOR ARRIVALS

Fast Track. The Agent (with the Passenger’s Name Sign) will be waiting for the passenger/s at the designated point (approved by the Airport Authorities), whether it will be at the end of the air-bridge or entrance of the arrivals Hall. The Passenger will be assisted and expedited through immigration and security check point. The Passenger may be expedited through customs if the local customs authorities permit it, but it cannot be guaranteed. Once the immigration and customs clearance are completed, the Agent will guide the passenger to baggage hall and on through to the public arrivals area to exit the airport. The Agent will liaise with the driver prior to the passenger’s arrival and arrange a Meeting point ensuring a smooth handover and completion of service.

Meet and Assist. The Agent (with the Passenger’s Name Sign) will be waiting for the Passenger at the designated point (approved by the Airport Authorities), whether it will be at the end of the air-bridge or entrance of the arrival's hall. The Passenger will be assisted through immigration and security check point; the Agent will try to expedite the process however it cannot be always guaranteed. The Passenger may be assisted through customs if the local customs authorities permit it but again cannot be guaranteed. Once the immigration and customs clearance are completed, the Agent will guide the Passenger to baggage hall and on through to the public arrivals area to exit the airport. The Agent will liaise with the driver prior to the Passenger’s arrival and arrange a meeting point ensuring a smooth handover and completion of service.

Landside Meet and Assist. The Agent (with the Passenger’s Name Sign) will be waiting for the Passenger at the designated point (approved by the Airport Authorities), whether it will be after immigration and customs in the baggage hall or in the public arrivals hall. The Agent will liaise with the driver prior to the Passenger’s arrival and arrange a meeting point ensuring a smooth handover and completion of service,.

FOR DEPARTURES

Fast Track. The Agent will begin by contacting the contact number provided for the Passenger or the driver (if the driver contacts details have been provided), prior to the Passenger’s arrival at the airport to arrange the time and meeting point. The Agent (with the Passenger’s Name Sign) will be waiting for the Passenger at the designated point (approved by the Airport Authorities), whether it will be kerbside directly outside the terminal or the agreed Meeting point. The Passenger will be assisted with airline check in formalities and expedited through immigration and security check point. The Passenger may be expedited through customs if the local customs authorities permit it but it cannot be guaranteed. Once the departure formalities are completed, the Agent will either guide the Passenger to the lounge (if the passenger/s's airline ticket entitles the lounge access or if it has been booked as an extra service) or to the gate to complete the service.

Meet and Assist. The Agent will begin by contacting the contact number provided for the lead passenger or the driver (if the driver contacts details have been provided) prior to the Passenger’s arrival at the airport to arrange the time and meeting point. The Agent (with the Passenger’s Name Sign) will be waiting for the Passenger/s at the designated point (approved by the Airport Authorities), whether it will be kerbside directly outside the terminal or the agreed meeting point. The Passenger will be assisted with airline check in formalities, immigration, and security check point; the Agent will try to expedite the process however it cannot be always guaranteed. The Passenger may be assisted through customs if the local customs authorities permit it but again cannot be guaranteed. Once the departure formalities are completed, the Agent will either guide the Passenger to the lounge (if the Passenger's airline ticket entitles the lounge access or if it has been booked as an extra service) or to the gate to complete the service.

The Agent will begin by contacting the contact number provided for the lead passenger or the driver (if the driver contacts details have been provided) prior to the Passenger’s arrival at the airport to arrange the time and Meeting point (approved by the Airport Authorities). The Agent (with the Passenger’s Name Sign) will be waiting for the Passenger at the designated point, whether it will be kerbside directly outside the terminal or the agreed Meeting point. The Passenger will be assisted through airline check in formalities (the Agent will try to expedite the process however it cannot be always guaranteed) and then guided to the security check point where our service will be completed.

FOR TRANSITS

Meet and Assist. The Agent (with the Passenger’s Name Sign) will be waiting for the Passenger at the designated point authorized by the Airport Authorities, whether it will be at the end of the air-bridge or entrance of the arrival's hall. The Passenger will be assisted through immigration and security check point. The Passenger may be assisted through customs if the local customs authorities permit it, but it cannot be guaranteed. Once the departure formalities are completed, the Agent will either guide Passenger to the lounge (if the Passenger's airline ticket entitles the lounge access or if it has been booked as an extra service) or to the gate to complete the service.

EXTRA TRAVEL SERVICES

Flowers on arrival. The Agent will be waiting for the Passenger at the Meeting point with a bouquet of fresh flowers. Baggage assistance. The arrival baggage porter will be waiting for the Passenger at the baggage belt. The porter will assist in transporting the luggage from baggage hall to transportation. The departure baggage porter will be waiting for the passenger at the Meeting point. The porter will assist in transporting the luggage to airline check in desk.
Visa on arrival assistance.
The Agent will assist and expedite (wherever available and allowed by Authorities) in completing the Visa on arrival solicitation. Please note that actual Visa fee is in addition and must be paid by the Passenger on arrival at the airport.
Airport Transfer.For arrival service, an executive car will be pre-booked to drive the Passenger from the airport to their booked drop off location and the Agent will liaise with the driver and escort the Passenger to the car for a smooth handover. For departure service an executive car will be pre booked to pick the passengers from their booked pick up location to drive them to the airport, the Agent will liaise with the driver and set up a Meeting point to ensure a smooth start of the service. Please note that an executive can accommodate up to 3 passengers and 2 large cases and 2 hand luggage.
MPV (Multipurpose Passenger Vehicle) Airport Transfer. For arrival service, an executive MPV will be pre-booked to drive the Passenger from the airport to their booked drop off location and the Agent will liaise with the driver and escort the Passenger to the car for a smooth handover. For departure service an executive MPV will be pre booked to pick the Passenger from their booked pick-up location to drive them to the airport, the Agent will liaise with the driver and set up a meeting point to ensure a smooth start of the service. Please note that an MPV can accommodate up to 5 passengers, 4 large cases and 4 hand luggage.
Airport Lounge. The Agent will take the Passenger to the pre-booked Airport Lounge after completing all the formalities. The Agent will leave the Passenger at the lounge and will return at the agreed time before boarding to escort the Passenger to the gate. Admittance to a Airport Lounge is strictly conditional upon Customers possessing (i) a valid permission issued by EasyToTravel (e.g. digital card, QR code or any other key), (ii) a valid boarding pass and (iii) any additional identification that the Airport Lounge may require from Passengers and their guests, which may include passport, national identity card or driving license. Some Airport Lounges in Europe are located within designated Schengen areas of the airport which means that access is only provided to these locations if Passengers are travelling between Schengen countries.
Smartdelay.If your flight is delayed by more than 2 hours, you get free access to the lounges available at EasyToTravel.
Document Handling Assistance. The Agent will liaise with the driver/contact number provided to collect documents from landside area and bring them over to the Passenger at airside area saving valuable time for the Passenger.

The information provided when using the EasyToTravel is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country. Accordingly, those persons who choose to access EasyToTravel from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable.

2. INTELLECTUAL PROPERTY

Our intellectual property. We are the owner or the licensor of all intellectual property rights in EasyToTravel, including all source code, databases, functionality, software, website designs (hereinafter as Software), Content, as well as the trademarks, service marks, and logos contained therein (the "Trademarks"). Our Software, Content and Trademarks are protected by copyright and trademark laws (and various other intellectual property rights and unfair competition laws). The Software, Content and Trademarks are provided in or through the EasyToTravel "AS IS" for your personal, non-commercial use or internal business purpose only.
Use of EasyToTravel. Subject to your compliance with these Terms, including the prohibitions section below, we grant you a non-exclusive, non-transferable, revocable license to:
(1) access the EasyToTravel;
and (2) download or print a copy of any part of the Content to which you have properly gained access.
solely for your personal, non-commercial use or internal business purpose. Except as set out in this section or elsewhere in our Terms, no part of the EasyToTravel, no Software, no Content or Trademarks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.
If you wish to make any use of the EasyToTravel, Software, Content, or Trademarks other than as set out in this section or elsewhere in our Terms, please address your request to: ab@easyto.travel. If we ever grant you the permission to post, reproduce, or publicly display any part of EasyToTravel or Content, you must identify us as the owners or licensors of the EasyToTravel, Software, Content, or Trademarks and ensure that any copyright or proprietary notice appears or is visible on posting, reproducing, or displaying.
We reserve all rights not expressly granted to you in and to the EasyToTravel, Software, Content, and Trademarks. Any breach of these Intellectual Property will constitute a material breach of our Terms and your right to use EasyToTravel will terminate immediately.
Submissions. Please review this section and the prohibitions section carefully prior to using EasyToTravel to understand the (a) rights you give us and (b) obligations you have when you post or upload any content through the EasyToTravel. By directly sending us any question, comment, suggestion, idea, feedback, or other information about the EasyToTravel ("Submissions"), you agree to assign to us all intellectual property rights in such Submission. You agree that we shall own this Submission and be entitled to its unrestricted use and dissemination for any lawful purpose, commercial or otherwise, without acknowledgment or compensation to you. You warrant and represent that your Submissions do not constitute confidential information.
You are solely responsible for your Submissions, and you expressly agree to reimburse us for all losses that we may suffer because of your breach of (a) this section, (b) any third party’s intellectual property rights, or (c) Governing law.

3. USER DECLARATIONS

By using the EasyToTravel, you declare and warrant that:
(1) all registration information you submit will be true, accurate, current, and complete;
(2) you will maintain the accuracy of such information and promptly update such sign-up information as necessary;
(3) you have the legal capacity and you agree to comply with these Terms;
(4) you are not under the age of 18;
(5) you are not a minor in the jurisdiction in which you reside, or if a minor, you have received parental permission to use the EasyToTravel;
(6) you will not access the EasyToTravel through automated or non-human means, whether through a bot, script or otherwise;
(7) you will not use the EasyToTravel for any illegal or unauthorized purpose; and
(8) your use of the EasyToTravel will not violate any applicable law or regulation.
If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your Account and refuse all current or future use of the EasyToTravel (or any part thereof).

You may be required to register to use EasyToTravel. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.
The EasyToTravel can be used by individuals over the age of 18. Signing up for EasyToTravel by an underage person is strictly prohibited. By accessing EasyToTravel, and signing up for an Account, you represent and warrant that you are 18 years of age or older, and that you have all the rights and authority necessary to transact and comply with the Terms, including that you are of legal age, have full legal capacity, and have legal capacity. We may at any time require you to provide information and documents evidencing your rights and authority as set forth above.
To use EasyToTravel you shall create an Account and become a User.
To create an Account, you can:
(1) fill out all mandatory fields of the sign-up (authorization) application.
(2) or log into EasyToTravel through"Facebook","Twitter", "Whatsap","Viber","Telegram","VK" (hereinafter referred to as "Social Media Account"). By using this functionality, you agree that EasyToTravel accesses, publishes, and stores certain information from your Social Network Account on EasyToTravel. You have the right to disconnect from your Account at any time. Please see “SOCIAL MEDIA” section and our Privacy Policy http://easyto.travel for more information about data usage and the privacy policy of the relevant social media.
To register the User in the EasyToTravel App, the User independently makes a download of the EasyToTravel App to their device using the AppStore (itunes.apple.com) and/or Google Play (play.google.com) on the Internet.
To register, you shall read and accept the Terms and the Privacy Policy http://easyto.travel By creating an Account, regardless of the chosen registration method, you agree to provide accurate and truthful information and to update it in your Account or by notifying the EasyToTravel in a timely manner, to ensure its relevance and accuracy throughout the duration of the Terms. In case of signing up via e-mail you undertake to ensure the confidentiality of the login and password you have chosen when creating your Account and not to share it with anyone else. You are solely responsible for the use of your Account by third parties.
To ensure transparency, increase trust, or prevent or detect fraud, the EasyToTravel may (but is not obliged to) verify some of the information you provide in your Account. This includes the phone number you provide. You can also voluntarily verify passport information.The EasyToTravel cannot guarantee the validity, reliability and accuracy of any information that has been verified.
It is forbidden to create multiple Accounts for one User (Prohibition of Multiple Accounts).
If you sign up for an EasyToTravel Account, you give us your consent to use your personal information in accordance with the privacy policy http://easyto.travel/privacypolicy

5. USER DATA

We will maintain certain data that you transmit to the EasyToTravel for the purpose of managing the performance of the EasyToTravel, as well as data relating to your use of the EasyToTravel. Although we perform regular routine backups of data, you are solely responsible for all data that you transmit or that relates to any activity you have undertaken using the EasyToTravel. You agree that we shall have no liability to you for any loss or corruption of any such data, and you hereby waive any right of action against us arising from any such loss or corruption of such data.

6. PURCHASES AND PAYMENTS

Prices are based on the currency of your choice at the time of booking. All provided quotations are only valid for that time and a late booking surcharge will be applicable for all bookings confirmed within 48 hours from the service time. Kindly note that this surcharge will be applicable even if you have received the quote but not confirmed the service booking.
Price quotations and price tables may change without notice however it will not affect any confirmed bookings. If a material amendment to an order or Booked Travel service is requested by the traveler or booker and is accepted by EasyToTravel then the amended Price will use the exchange rates and tariffs subsisting at the time of change and extra charges may be payable.
The base Price quoted at the time of ordering will include all knowable charges for the Travel service that has been ordered. Prices do not include foreign departure tax, security, port charges, customs, immigration, agricultural, passenger-facility charges or international transportation tax or any local airport taxes either imposed by airport, airline, or any airport contractor. Prices do not include discretionary tips/gratuities to representatives; or passport and visa fees; or baggage and personal insurance. Prices do not include provision for a porter, lounge access or in terminal buggy unless booked at additional costs and confirmed in the booking confirmation.
EasyToTravel will charge a 50% (of total Travel service Price) late booking fee/surcharge for all new bookings confirmed within 48 hours of the service time. This charge will be applicable even if the Customer has received a price quote outside 48 hours but have not confirmed the booking regardless of the reason. If the Customer makes a purchase using a EasyToTravel promotion code, or if the Customer accepts a discount or special-offer price during the EasyToTravel checkout or ordering process, The Customer may invalidate that discount or special-offer price by making any changes or amendments to the original itinerary once the purchase is complete. The EasyToTravel may decide, at its sole discretion, to honor the awarded discount or special-offer pricing if the Customer makes a post-purchase change or amendment. The EasyToTravel reserves the right to invalidate the Customer discount or special-offer pricing in case of the Customer making any change to the service originally ordered. Access to EasyToTravel is free of charge.
The EasyToTravel automatically calculates the Price of the Travel services, which includes the cost of the selected Travel service and the EasyToTravel Fee. The intelligent algorithms of the EasyToTravel operate in dynamic pricing mode, where the cost of the Travel services and EasyToTravel Fee are determined based on constantly changing factors, such as estimated time and distance, time of arrival/departure, number of Passengers, size, and number of pieces of luggage, projected route, estimated traffic, quantity, etc.
The EasyToTravel stores the history of all orders of the User in Account. The registered User may at any time obtain details and a history of all orders for any period starting from the date of his or her registration with EasyToTravel.
To pay for the Travel services, the User ties (enters data) to EasyToTravel his Payment cards which are automatically integrated with EasyToTravel, from which the funds will be deducted to pay for the Travel services under the Terms. It is allowed to use payment cards only of those payment systems which are specified in EasyToTravel and can make Internet payments. Usually these payment systems are VISA/MasterCard. The possibility of Internet payments is provided by the User independently through the issuing bank of the Payment card. We accept the following forms of payment:
- Visa
- Mastercard
- American Express
- Discover
- PayPal
- Adyen
When you are choosing the method of payment “by Payment card” after the Booking of the Travel service, the User will be redirected to the secure payment page of the relevant payment system or the system of the relevant bank, where he or she must enter the data of his or her Payment card. For additional authentication of the holder the 3D Secure protocol is used. If the User's bank supports this technology, the User will be redirected to its server for additional identification. Information about the rules and methods of additional identification the User can specify in the bank, which issued his Payment card. The User has an opportunity to link the Payment Card to his Account. Afterwards, the amount of any subsequent order of the User will be automatically debited from the Payment Card attached to the Account without specifying any details, provided that the User confirms the payment by pressing the"Pay" button in the Account and entering a one-time password, provided that the issuing bank of the User's Payment Card provides for the use of such protection. The debited amount from the User's Payment Card is held by EasyToTravel until the moment of successful rendering of the Travel services.
The funds are refunded only to the Payment card from which the payment was made, in accordance with the rules of international payment systems and Governing law. The use of Payment card may be chargeable. No refunds will be made for Payment card charge or service fee.
When you make online payments, your data is protected and processed according to the PCI DSS security standard. Transmission of information to the payment gateway is performed using SSL encryption technology. Further transmission of information occurs through closed banking networks, which have the highest level of security.
All payment operations are performed in accordance with the requirements of international payment systems. When transmitting information, special security technologies of online card payments are used, data processing is carried out on a secure high-tech server of the processing company. The EasyToTravel is not responsible for operations related to online payments.
The authorization of the online operations is carried out by the bank. If the bank has reasons to believe that the operation is fraudulent in nature, the bank has the right to refuse to carry out this operation. Fraudulent transactions with the Payment cards are a criminal offense.
You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Travel services. You further agree to promptly update account and payment information, including email address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as needed. Sales tax will be added to the price of purchases as deemed required by us. We may change prices at any time. You agree to pay all charges at the prices then in effect for your purchases and you authorize us to charge your chosen payment provider for any such amounts upon placing your order. We reserve the right to correct any errors or mistakes in pricing, even if we have already requested or received payment. We reserve the right to refuse any order placed through the EasyToTravel. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same Customer Account, the same payment method, etc. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.

7. CANCELLATION

You can cancel your subscription at any time by logging into your Account.

8. PROHIBITIONS

You may not access or use the EasyToTravel for any purpose other than that for which we make the EasyToTravel available. The EasyToTravel may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us.
As a User of the EasyToTravel, you agree not to:
1. Systematically retrieve data or other content from the EasyToTravel to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.
2. Trick, defraud, or mislead us and other Users, especially in any attempt to learn sensitive Account information such as User passwords.
3. Circumvent, disable, or otherwise interfere with security-related features of the EasyToTravel, including features that prevent or restrict the use or copying of any Content or enforce limitations on the use of the EasyToTravel and/or the Content contained therein.
4. Disparage, tarnish, or otherwise harm, in our opinion, us and/or the EasyToTravel.
5. Use any information obtained from the EasyToTravel to harass, abuse, or harm another person.
6. Make improper use of our support or submit false reports of abuse or misconduct.
7. Use the EasyToTravel in a manner inconsistent with any applicable laws or regulations.
8. Engage in unauthorized framing of or linking to the EasyToTravel.
9. Upload or transmit (or attempt to upload or to transmit) viruses, trojans, or other material, including excessive use of capital letters and spamming (continuous posting of repetitive text), that interferes with any party’s uninterrupted use and enjoyment of the EasyToTravel or modifies, impairs, disrupts, alters, or interferes with the use, features, functions, operation, or maintenance of the EasyToTravel.
10. Engage in any automated use of the system, such as using scripts to send comments or messages, or using any data mining, robots, or similar data gathering and extraction tools.
11. Delete the copyright or other proprietary rights notice from any Content.
12. Attempt to impersonate another User or person or use the username of another User.
13. Upload or transmit (or attempt to upload or to transmit) any material that acts as a passive or active information collection or transmission mechanism, including without limitation, clear graphics interchange formats ("gifs"), 1×1 pixels, web bugs, cookies, or other similar devices (sometimes referred to as "spyware" or "passive collection mechanisms" or"pcms").
14. Interfere with, disrupt, or create an undue burden on the EasyToTravel or the networks or services connected to the EasyToTravel.
15. Harass, annoy, intimidate, or threaten any of our employees or agents engaged in providing any portion of the EasyToTravel to you.
16. Attempt to bypass any measures of the EasyToTravel designed to prevent or restrict access to the EasyToTravel, or any part of the EasyToTravel.
17. Copy or adapt the EasyToTravel software, including but not limited to Flash, PHP, HTML, JavaScript, or other code.
18. Except as permitted by Governing law, decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the EasyToTravel.
19. Except as may be the result of standard search engine or Internet browser usage, use, launch, develop, or distribute any automated system, including without limitation, any spider, robot, cheat utility, scraper, or offline reader that accesses the EasyToTravel, or use or launch any unauthorized script or other software.
20. Use a buying agent or purchasing agent to make purchases on the EasyToTravel.
21. Make any unauthorized use of the EasyToTravel, including collecting usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email, or creating user accounts by automated means or under false pretenses.
22. Use the EasyToTravel as part of any effort to compete with us or otherwise use the EasyToTravel and/or the Content for any revenue-generating endeavor or commercial enterprise.
23. Use the EasyToTravel to advertise or offer to sell services.
24. Sell or otherwise transfer your Account.

9. USER CONTRIBUTION LICENSE

You agree that we may access, store, process, and use any information and personal data that you provide following the terms of the Privacy Policy and your choices (including settings).
By submitting suggestions or other feedback regarding the EasyToTravel, you agree that we can use and share such feedback for any purpose without compensation to you.

10. REVIEWS AND FEEDBACKS

We may provide you areas on the EasyToTravel to leave reviews or ratings. When posting a review, you must comply with the following criteria: (1) you should have firsthand experience with the person/entity being reviewed; (2) your reviews should not contain offensive profanity, or abusive, racist, offensive, or hateful language; (3) your reviews should not contain discriminatory references based on religion, race, gender, national origin, age, marital status, sexual orientation, or disability; (4) your reviews should not contain references to illegal activity; (5) you should not be affiliated with competitors if posting negative reviews; (6) you should not make any conclusions as to the legality of conduct; (7) you may not post any false or misleading statements; and (8) you may not organize a campaign encouraging others to post reviews, whether positive or negative.
We may accept, reject, or remove reviews in our sole discretion. We have absolutely no obligation to screen reviews or to delete reviews, even if anyone considers reviews objectionable or inaccurate. Reviews are not endorsed by us, and do not necessarily represent our opinions or the views of any of our affiliates or Service partner. We do not assume liability for any review or for any claims, liabilities, or losses resulting from any review. By posting a review, you hereby grant to us a perpetual, non-exclusive, worldwide, royalty-free, fully paid, assignable, and sublicensable right and license to reproduce, modify, translate, transmit by any means, display, perform, and/or distribute all content relating to review.

11. MOBILE APP LICENSE

User License

If you access the Travel services via the EasyToTravel App, then we grant you a revocable, non-exclusive, non-transferable, limited right to install and use the EasyToTravel App on wireless electronic devices owned or controlled by you, and to access and use the EasyToTravel App on such devices strictly in accordance with Terms. You shall not:
(1) except as permitted by Governing law, decompile, reverse engineer, disassemble, attempt to derive the source code of, or decrypt the EasyToTravel App;
(2) make any modification, adaptation, improvement, enhancement, translation, or derivative work from the EasyToTravel App;
(3) violate any applicable laws, rules, or regulations in connection with your access or use of the EasyToTravel App;
(4) remove, alter, or obscure any proprietary notice (including any notice of copyright or trademark) posted by us or the licensors of the EasyToTravel App;
(5) use the EasyToTravel App for any revenue-generating endeavor, commercial enterprise, or other purpose for which it is not designed or intended;
(6) make the EasyToTravel App available over a network or other environment permitting access or use by multiple devices or users at the same time;
(7) use the EasyToTravel App for creating a product, service, or software that is, directly or indirectly, competitive with or in any way a substitute for the EasyToTravel App;
(8) use the EasyToTravel App to send automated queries to any website or to send any unsolicited commercial email; or
(9) use any proprietary information or any of our interfaces or our other intellectual property in the design, development, manufacture, licensing, or distribution of any applications, accessories, or devices for use with the EasyToTravel App.

App stores (Apple and Android devices)

The following terms apply when you use the EasyToTravel App obtained from either the Apple Store or Google Play (each an "App Distributor"). The license granted to you for our EasyToTravel App is limited to a non-transferable license to use the application on a device that utilizes the Apple iOS or Android operating systems, as applicable, and in accordance with the usage rules set forth in the applicable App Distributor’s terms of service.
Apple Store. By downloading the EasyToTravel App from an Apple Inc. ("Apple") device or from the Apple AppStore, you acknowledge and agree that:
(i) The Agreement is between the EasyToTravel and you; Apple is not a party to the Terms.
(ii) the rights granted to you under the Terms are limited to your personal, limited, non-transferable right to install the EasyToTravel App on Apple devices that you own or operate for personal, non-commercial use, subject to the usage rules set forth in the Apple AppStore services.
(iii) Apple is not responsible for the EasyToTravel or its Content and has no obligation to provide any service or support for the EasyToTravel App.
(iv) if the EasyToTravel App fails to comply with the applicable warranty, you may notify Apple, and Apple will refund your purchase price of the EasyToTravel App, if any. To the maximum extent permitted by Governing Law, Apple will have no other warranty obligations with respect to the EasyToTravel App.
(iii) Apple is not responsible for any claims from you or any third party relating to EasyToTravel App, your possession or use of EasyToTravel App, including without limitation (a) product quality claims; (b) any claims that EasyToTravel App does not comply with all applicable laws and regulations; and (c) claims arising under consumer protection or similar laws.
(iv) If any third party claims that EasyToTravel App or your use of EasyToTravel App infringes such third party's intellectual property rights, Apple will not be responsible for investigating, defending, resolving or dismissing such intellectual property infringement claims.
(iii) You represent and warrant that (a) You are not located in a country that is subject to a U.S. Government embargo or has been designated by the U.S. Government as a"terrorist supporting" country; and (b) You are subject to any restrictions by the U.S. Government.
(iv) Apple and its subsidiaries are third party beneficiaries of the Terms, and upon your acceptance of the terms of the Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce these terms against you as a third-party beneficiary of the Terms.Google Play. By downloading the EasyToTravel App from the Google Play app store (or its successors) operated by Google, Inc. or one of its affiliates ("Google"), you acknowledge and agree that:
1. in the event of a conflict between (a) the Google Play User Agreement, the Google Play Business and Program Policy, or other agreements that Google defines by default as the Google Play app store end user license (which are collectively referred to as"Google Play Agreements"), and (b) other terms and conditions in the Agreement, the Google Play Agreements will apply to your use of the EasyToTravel App that you downloaded from Google Play, and
2. Google shall not be responsible or liable in any way for the compliance or non-compliance of the EasyToTravel App or you (or any other User) with the Google Play Agreement or the Google Play Agreement.

12. THIRD-PARTY SOFTWARE

The EasyToTravel may use third-party applications, services, software products or APIs, for example, we use Google's Google maps service (https://www.google.ru/maps) to determine geolocation; Flightradar and Variflight to tracking real-time information about aircraft and flight status data (or https://www.flightradar24.com/ and https://www.variflight.com/); etc.
By using EasyToTravel you agree to accept the terms of use of those third-party applications, services, products, or APIs. Some of these apps, services, software products or APIs have their own licenses and terms of use.
The EasyToTravel provides any Third-Party Software to You in accordance with the standard license terms provided by the applicable third party. Your use of any Third-Party Software as part of the Services or that integrates with Our software is subject to the terms of the agreement with the provider of that Third Party Software and its warranties. We are not responsible for the performance, features or failures of the Third-Party Software and make no warranty as to the suitability of the Third-Party Software for Your purposes.

As part of the functionality of the EasyToTravel, you may link your account (each such account, a "Social Media Account") with online accounts you have with third-party service providers (hereinafter as “Social Media Provider”) by either: (1) providing your Social Media Account login information through the EasyToTravel; or (2) allowing us to access your Social Media Account, as is permitted under the applicable terms and conditions that govern your use of each Social Media Account.
You represent and warrant that you are entitled to disclose your Social Media Account login information to us and/or grant us access to your Social Media Account, without breach by you of any of the terms and conditions that govern your use of the applicable Social Media Account, and without obligating us to pay any fees or making us subject to any usage limitations imposed by the third-party service provider of the Social Media Account. By granting us access to any Social Media Accounts, you understand that (1) we may access, make available, and store (if applicable) any content that you have provided to and stored in your Social Media Account (the "Social Media Content") so that it is available on and through the EasyToTravel via your Account, including without limitation any friend lists and (2) we may submit to and receive from your Social Media Account additional information to the extent you are notified when you link your Account with the Social Media Account. Depending on the Social Media Accounts you choose and subject to the privacy settings that you have set in such Social Media Accounts, personally identifiable information that you post to your Social Media Accounts may be available on and through your Account on the EasyToTravel. Please note that if a Social Media Account or associated service becomes unavailable or our access to such Social Media Account is terminated by the Social Media Provider, then Social Media Content may no longer be available on and through the EasyToTravel.
You will have the ability to disable the connection between your Account on the EasyToTravel and your Social Media Accounts at any time. PLEASE NOTE THAT YOUR RELATIONSHIP WITH THE THIRD-PARTY SERVICE PROVIDERS ASSOCIATED WITH YOUR SOCIAL MEDIA ACCOUNTS IS GOVERNED SOLELY BY YOUR AGREEMENT(S) WITH SUCH SOCIAL MEDIA PROVIDERS. We make no effort to review any Social Media Content for any purpose, including but not limited to, for accuracy, legality, or non-infringement, and we are not responsible for any Social Media Content. You acknowledge and agree that we may access your email address book associated with a Social Media Account and your contacts list stored on your mobile device or tablet computer solely for purposes of identifying and informing you of those contacts who have also registered to use the EasyToTravel. You can deactivate the connection between the EasyToTravel and your Social Media Account by contacting us using the contact information below or through your Account settings (if applicable). We will attempt to delete any information stored on our servers that was obtained through such Social media Account, except the username and profile picture that become associated with your Account.

14. ADVERTISERS

We allow advertisers to display their advertisements and other information in certain areas of the EasyToTravel, such as sidebar advertisements or banner advertisements. We simply provide the space to place such advertisements, and we have no other relationship with advertisers.

15. MANAGEMENT

We reserve the right, but not the obligation, to:
(1) monitor for violations of these Terms;
(2) take appropriate legal action against anyone who, in our sole discretion, violates the law or these Terms, including without limitation, reporting such user to law enforcement authorities;
(3) in our sole discretion and without limitation, refuse, restrict access to, limit the availability of, or disable (to the extent technologically feasible) any of your Declarations or any part thereof;
(4) in our sole discretion and without limitation, notice, or liability, to remove from the EasyToTravel or otherwise disable all files and content that are excessive in size or are in any way burdensome to our systems; and
(5) otherwise manage the EasyToTravel in a manner designed to protect our rights and property and to facilitate the proper functioning of the EasyToTravel.

16. PRIVACY POLICY

We care about data privacy and security. Please review our Privacy Policy: http://easyto.travel. By using the EasyToTravel, you agree to be bound by our Privacy Policy, which is incorporated into these Terms. Please be advised the EasyToTravel are hosted in UAE. If you access the EasyToTravel from any other region of the world with laws or other requirements governing personal data collection, use, or disclosure that differ from Governing laws in UAE, then through your continued use of the EasyToTravel, you are transferring your data to UAE, and you expressly consent to have your data transferred to and processed in UAE. The contact information and other information about the User when signing up with EasyToTravel (creating an Account) and when the User changes the Account is automatically transmitted to the EasyToTravel servers when the User uses EasyToTravel through the software installed on the User's device, including the IP address, cookie information, information about the User's browser (or other program with which access to EasyToTravel is made), access time, the address of the requested page.
The EasyToTravel does not verify the accuracy of the data provided by Users and does not monitor their competence. The EasyToTravel assumes that the User provides accurate and sufficient information to communicate with the User on the issues proposed in the registration form, and keeps this information up to date.
The User can at any time change (update, supplement) the information or part of it by using the function of editing the registration information in the Account. The User has the right to delete his Account in EasyToTravel on his own or by contacting ab@easyto.travel. The EasyToTravel has no control over, and assumes no responsibility for, Third Party websites that Users may access through links available from EasyToTravel. Such websites may collect or solicit other information from the User and may engage in other activities.

17. TERM AND TERMINATION

These Terms shall remain in full force and effect while you use the EasyToTravel. WITHOUT LIMITING ANY OTHER PROVISION OF THESE TERMS, WE RESERVE THE RIGHT TO, IN OUR SOLE DISCRETION AND WITHOUT NOTICE OR LIABILITY, DENY ACCESS TO AND USE OF THE EASYTOTRAVEL (INCLUDING BLOCKING CERTAIN IP ADDRESSES), TO ANY PERSON FOR ANY REASON OR FOR NO REASON, INCLUDING WITHOUT LIMITATION FOR BREACH OF ANY DECLARATION, WARRANTY, OR COVENANT CONTAINED IN THESE TERMS OR OF ANY APPLICABLE LAW OR REGULATION. WE MAY TERMINATE YOUR USE OR PARTICIPATION IN THE EASYTOTRAVEL OR DELETE YOUR ACCOUNT AND ANY CONTENT OR INFORMATION THAT YOU POSTED AT ANY TIME, WITHOUT WARNING, IN OUR SOLE DISCRETION.
If we terminate or suspend your Account for any reason, you are prohibited from registering and creating a new account under your name, a fake or borrowed name, or the name of any third party, even if you may be acting on behalf of the third party. In addition to terminating or suspending your Account, we reserve the right to take appropriate legal action, including without limitation pursuing civil, criminal, and injunctive redress. Termination of the Terms for any reason shall not relieve the Users from liability for breach of the Terms arising during the term of its validity.

18. AMEDMENTS, MODIFICATIONS AND DOWN TIME

We reserve the right to change, modify, or remove the contents of the EasyToTravel at any time or for any reason at our sole discretion without notice. However, we have no obligation to update any information on EasyToTravel. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the EasyToTravel.
We cannot guarantee the EasyToTravel will be always available. We may experience hardware, software, or other problems or need to perform maintenance related to the EasyToTravel, resulting in interruptions, delays, or errors. We reserve the right to change, revise, update, suspend, discontinue, or otherwise modify the EasyToTravel at any time or for any reason without notice to you. You agree that we have no liability whatsoever for any loss, damage, or inconvenience caused by your inability to access or use the EasyToTravel during any downtime or discontinuance of the EasyToTravel. Nothing in these Terms will be construed to obligate us to maintain and support the EasyToTravel or to supply any corrections, updates, or releases in connection therewith.

19. GOVERNING LAW

These Terms are governed by and interpreted following the laws of UAE and international law. If your habitual residence is in the EU, and you are a consumer, you additionally possess the protection provided to you by obligatory provisions of the law in your country to residence. EasyToTravel and yourself both agree to submit to the non-exclusive jurisdiction of the courts of UAE, which means that you may make a claim to defend your consumer protection rights regarding these Terms in UAE, or in the country in which you reside.

20. DISPUTES

Negotiations. To expedite resolution and control the cost of any dispute, controversy, or claim related to these Terms (hereinafter as a "Dispute" and collectively, the"Disputes") brought by either you or us (hereinafter, individually, as a "Party" and collectively, the"Parties"), the Parties agree to first attempt to negotiate any Dispute (except those Disputes expressly provided below) informally for at least 30 days before initiating arbitration. Such informal negotiations commence upon written notice from one Party to the other Party.
DIAC. Any Dispute arising out of or in connection with these Terms, including any question regarding its existence, validity, or termination, shall be referred to the Dubai International Arbitration Centre (DIAC) and finally resolved by arbitration under the DIAC Arbitration Rules in force on the date of the submission of the request for arbitration (“the Rules”), which Rules are deemed to be incorporated by reference into this clause. The number of arbitrators, to be appointed in accordance with the Rules, shall be one. The legal seat of the arbitration shall be one and the language of the arbitration shall be English. The venue, seat and place of the arbitration proceedings shall exclusively be at Dubai.
Restrictions. The Parties agree that any arbitration shall be limited to the Dispute between the Parties individually. To the full extent permitted by law, (a) no arbitration shall be joined with any other proceeding; (b) there is no right or authority for any Dispute to be arbitrated on a class-action basis or to utilize class action procedures; and (c) there is no right or authority for any Dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.
Exceptions to Negotiations and DIAC. The Parties agree that the following Disputes are not subject to the above provisions concerning informal negotiations binding arbitration: (a) any Disputes seeking to enforce or protect, or concerning the validity of, any of the intellectual property rights of a Party; (b) any Dispute related to, or arising from, allegations of theft, piracy, invasion of privacy, or unauthorized use; and (c) any claim for injunctive relief. If this provision is found to be illegal or unenforceable, then neither Party will elect to arbitrate any Dispute falling within that portion of this provision found to be illegal or unenforceable and such Dispute shall be decided by a court of competent jurisdiction within the courts listed for jurisdiction above, and the Parties agree to submit to the personal jurisdiction of that court.

21. DISCLAIMER

THE EASYTOTRAVEL IS PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE EASYTOTRAVEL WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE EASYTOTRAVEL AND YOUR USE THEREOF, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THE EASYTOTRAVEL CONTENT OR THE CONTENT OF ANY WEBSITES OR MOBILE APPLICATIONS LINKED TO THE EASYTOTRAVEL AND WE WILL ASSUME NO LIABILITY OR RESPONSIBILITY FOR ANY (1) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT AND MATERIALS, (2) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF THE EASYTOTRAVEL SERVICES, (3) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (4) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE EASYTOTRAVEL, (5) ANY BUGS, VIRUSES, TROJANS, OR THE LIKE WHICH MAY BE TRANSMITTED TO OR THROUGH THE EASYTOTRAVEL BY ANY THIRD PARTY, AND/OR (6) ANY ERRORS OR OMISSIONS IN ANY CONTENT AND MATERIALS OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE EASYTOTRAVEL. WE DO NOT WARRANT, ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY PRODUCT OR SERVICE ADVERTISED OR OFFERED BY A THIRD PARTY THROUGH THE EASYTOTRAVEL, ANY HYPERLINKED WEBSITE, OR ANY WEBSITE OR MOBILE APPLICATION FEATURED IN ANY BANNER OR OTHER ADVERTISING, AND WE WILL NOT BE A PARTY TO OR IN ANY WAY BE RESPONSIBLE FOR MONITORING ANY TRANSACTION BETWEEN YOU AND ANY THIRD-PARTY PROVIDERS OF PRODUCTS OR SERVICES. AS WITH THE PURCHASE OF A PRODUCT OR SERVICE THROUGH ANY MEDIUM OR IN ANY ENVIRONMENT, YOU SHOULD USE YOUR BEST JUDGMENT AND EXERCISE CAUTION WHERE APPROPRIATE.

22. LIMITATIONS OF LIABILITY

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE EASYTOTRAVEL, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

23. INDEMNIFICATION

You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all our respective officers, Аgents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of:
(1) use of the EasyToTravel;
(2) breach of these Terms;
(3) any breach of your Declarations and warranties set forth in these Terms;
(4) your violation of the rights of a third party, including but not limited to intellectual property rights; or
(5) any overt harmful act toward any other User of the EasyToTravel with whom you connected via the EasyToTravel.
Notwithstanding the foregoing, we reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate, at your expense, with our defense of such claims. We will use reasonable efforts to notify you of any such claim, action, or proceeding which is subject to this indemnification upon becoming aware of it.

24. E-COMMUNICATIONS, SIGNATURES AND TRANSACTIONS

Visiting the EasyToTravel, sending us emails, and completing online forms constitute electronic communications.
